Copyright & Intellectual Property Policy

1. Ownership of the Comprehenza Platform

The Comprehenza iOS application and all of its constituent elements are the exclusive intellectual property of our team. This includes, but is not limited to:

  • Source Code: The entire Swift codebase of the iOS application, including all custom frameworks, utilities, and integrations, is proprietary and copyright protected.
  • Visual Design: All interface designs, iconography, colour palettes, typography choices, layout compositions, and the overall visual identity of the Comprehenza application and its Legal Center website are protected by copyright.
  • Brand Assets: The name "Comprehenza", the "Comprehenza Quotient" (CQ), the "ReadBuddy" persona, and any associated logos, wordmarks, or brand identifiers are trademarks of Comprehenza. They may not be used in any commercial or public context without prior written permission.
  • Proprietary Methodologies: The Learning Journey framework, the Comprehenza Quotient (CQ) scoring algorithm, and the four-pillar literacy assessment system (Fluency, Vocabulary, Comprehension, and Retelling) are original educational methodologies developed by our team and are protected as intellectual property.
  • Structural Compilation: The selection, arrangement, structure, and sequencing of reading exercises and comprehension questions within the Comprehenza Library — including the pedagogical approach to ordering content by Flesch-Kincaid grade level and aligning passages to Jeanne Chall's stages of reading development — is protected as a copyrighted compilation under applicable copyright law.

2. User Licence to Use the App

By creating a valid account, parents/guardians are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the Comprehenza application for its intended purpose: the educational reading development of a single child in Grades 6 to 9 within their care.

This licence explicitly does not include the right to:

  • Copy, reproduce, or redistribute any portion of the App's source code or design assets.
  • Create derivative works based on the App's interface, features, or methodology.
  • Extract, scrape, or systematically download reading passages or comprehension questions from the Library for use outside of the App environment.
  • Sublicense the App or transfer access to the App to another party.
  • Use Comprehenza's name, brand, or trademarks in any public-facing context, including social media, blogs, or commercial materials, without prior written consent from us.
  • Reverse-engineer, decompile, or disassemble any part of the App's binary code or underlying technology.

Violation of any of these licence restrictions may result in immediate termination of your account and access to the App, without prior notice, and may also expose you to legal liability under applicable copyright and intellectual property law.

3. Copyrighted Compilation and Proprietary Content Pipeline

Comprehenza's reading passages, comprehension questions, vocabulary exercises, and ReadBuddy responses are produced through a proprietary content pipeline that combines advanced language model technology with rigorous human editorial oversight. Team Comprehenza asserts copyright ownership over this body of work on the following basis:

  • Compilation Copyright: The selection, coordination, and arrangement of all educational content within the Comprehenza Library constitutes an original copyrighted compilation under applicable law. Comprehenza's substantial creative input — in defining the content structure, pedagogical framework, readability targets (Flesch-Kincaid grade levels), and quality standards — satisfies the originality threshold for copyright protection.
  • Editorial Direction and Control: All content produced through our pipeline is generated under our direction, with specific pedagogical parameters grounded in established research including Vygotsky's Zone of Proximal Development, Beck's Tier 2 vocabulary instruction model, and the National Reading Panel's five pillars of reading instruction (phonemic awareness, phonics, fluency, vocabulary, and comprehension). The resulting outputs reflect deliberate editorial choices, not arbitrary generation.
  • User Licence Scope: Users are licensed to engage with this content within the App environment for personal, non-commercial educational purposes only. Users may not republish, commercially distribute, or claim authorship of content accessed within the App.
  • No Third-Party Reproduction: Our content generation protocols are configured to produce original educational material rather than reproduce identifiable copyrighted third-party texts. If you believe any content within the App infringes upon a third-party copyright, please report it immediately (see Section 6).

4. Permitted Educational Use

Comprehenza is designed to be used within an educational context. The following uses are considered permitted and fall within the scope of the licence granted:

  • A child reading a Library passage and discussing it with their parent or teacher as part of their learning activity.
  • A parent or teacher referencing a child's Comprehenza Quotient (CQ) score in an educational assessment conversation (e.g., in a parent-teacher meeting).
  • A teacher recommending the Comprehenza App to parents of students who might benefit from additional reading practice at home.
  • Brief, attributed quotation of small excerpts from App content for the purposes of educational commentary or review (e.g., in a school report or academic review of the application), consistent with fair use/fair dealing principles.
  • Sharing a child's progress report or achievements with educational professionals, counsellors, or learning specialists for the purpose of supporting the child's literacy development.

Any use beyond these permitted activities requires prior written consent from us. Commercial use of any content accessed through the App — including but not limited to incorporation into competing educational products, training datasets, or published materials — is strictly prohibited.

5. Respecting Third-Party Intellectual Property

We are committed to operating within the bounds of copyright law and respecting the intellectual property rights of authors, publishers, and content creators. Our approach includes:

  • Original Content Generation: Our content pipeline is configured to generate original educational passages calibrated to specific readability levels, rather than reproduce existing published works. We do not intentionally incorporate substantial portions of copyrighted books, textbooks, news articles, or other protected materials.
  • Public Domain Sources: Where readings are inspired by or based upon public domain works (e.g., classic literature where copyright has expired), this is done legitimately and without infringing on the rights of current publishers or derivative rights holders.
  • Research and Academic References: Where our content and methodology references established educational research — such as the Flesch-Kincaid readability scale, findings from the National Reading Panel (2000), Vygotsky's ZPD framework, or Beck, McKeown, and Kucan's vocabulary instruction tiers — we do so for purposes of educational commentary and accuracy, consistent with fair use principles.
  • Third-Party Software: We use open-source software and frameworks in accordance with their respective licences (see Section 7). We acknowledge the open-source community whose work contributes to the technological foundations of the App.
  • Apple Platform Technologies: Comprehenza is built using Apple's proprietary frameworks (SwiftUI, Core Data, etc.) under Apple's Developer License Agreement. Our use of these technologies complies with all applicable Apple licence terms.

6. Copyright Infringement Reporting (DMCA-Style Notice)

If you are a copyright owner and believe in good faith that content within the Comprehenza application infringes your copyright, please send a notice to our support team containing the following information:

  • A description of the copyrighted work you claim has been infringed.
  • A description of where the allegedly infringing content appears within the Comprehenza App (e.g., the type of exercise or passage, the approximate reading level, and if possible the approximate date/time you encountered it).
  • Your contact information (name, email address, and mailing address if applicable).
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law.
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.
  • Your physical or electronic signature (or the signature of the person authorised to act on behalf of the copyright owner).

We will investigate all valid notices and take appropriate action, which may include removing or modifying the allegedly infringing content, adjusting our content generation parameters, or responding to you with further information. We aim to acknowledge receipt within 5 business days and provide a substantive response within 15 business days.

7. Open Source Acknowledgements

The Comprehenza iOS application is built upon a foundation of open-source technologies. We are grateful to the open-source community for their contributions. Key technologies include:

  • Swift Programming Language: Apple's open-source programming language, used under the Apache 2.0 licence with Runtime Library Exception.
  • SwiftUI Framework: Apple's declarative UI framework, used under Apple's Developer License Agreement.
  • Supabase SDK: An open-source Firebase alternative, used for secure authentication and cloud data storage under the MIT licence.

We use all open-source software in strict accordance with their respective licence terms (MIT, Apache 2.0, BSD, etc.). A full list of open-source dependencies and their licences is available on request at comprehenza.support@gmail.com.

8. Software Licensing and Distribution

Comprehenza is distributed exclusively through the Apple App Store. Your use of the App is also governed by the following:

  • Apple Licensed Application End User License Agreement (EULA): Unless superseded by these terms, the standard Apple EULA applies to your download and use of the Comprehenza App. In the event of any conflict between these terms and the Apple EULA, the more restrictive provision shall apply.
  • No Standalone Distribution: The Comprehenza App may not be distributed, shared, side-loaded, or made available through any channel other than the Apple App Store. Any copy of the App obtained outside of the App Store is unauthorised and should not be used.
  • Updates and Maintenance: We may release updates to the App from time to time. While we endeavour to maintain backward compatibility, we reserve the right to discontinue support for older versions of iOS in accordance with our update policy. Significant changes to the App will be communicated via the Changes to Terms page.
  • No Warranty on Availability: While we strive to keep the App available and functional, we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.
